شروط الاستخدام — تطبيق تأكّد

١. مقدم الخدمة والاتفاق

يُقدَّم تطبيق وموقع TAAKAD («تأكّد» أو «نحن») من: شادي الحروب (Shadi Al Hroub) — مطوّر فرد (لا شركة ولا كيان مسجّل) — الإمارات العربية المتحدة. قناة التواصل والإخطارات القانونية: support@taakad.app

باستخدامك التطبيق أو إنشائك حساباً توافق على هذه الشروط وسياسة الخصوصية. إذا لم توافق فلا تستخدم التطبيق.

٢. الأهلية

إنشاء الحساب وشراء الاشتراك يتطلبان أهلية قانونية لإبرام هذا الاتفاق. على من لا يملكها بحسب قانونه المحلي استخدام الخدمة عبر ولي أمر أو وصي، ويمكن للآباء والأوصياء استخدام تأكّد لحماية أسرهم. لا يجوز استخدام التطبيق إذا كان قانونك يمنعك من ذلك.

٣. الخدمة والخطتان

يتيح التطبيق إرسال نص أو رسالة أو رابط أو رقم أو صورة أو لقطة شاشة للفحص، ويعرض نتيجة إرشادية وأسباباً ومقترحات تحقق أو إبلاغ عند توفرها، وقد يوفر حساباً وسجل فحوصات وإشعارات وتصديراً وحذفاً للحساب.

يقدَّم تأكّد بخطتين:

• الخطة المجانية: أنواع الفحص الأساسية، وحدّ يومي لعدد الفحوصات، وميزة حماية هوية المتصل لكل حساب مسجَّل.
• اشتراك «برو» المدفوع: أنواع فحص إضافية، وفحص ملف الفيديو من جهازك عبر مشهد يُستخرج على الجهاز نفسه دون رفع الملف. أمّا فحص الفيديو برابط (يوتيوب أو تيك توك أو أي رابط تلصقه) فمجاني بالكامل ويمر بمسار فحص الروابط العادي.

لا يعني توفير خطة مجانية التزامنا بإبقائها إلى الأبد أو دون تغيير، وسنقدم إفصاحات محدّثة قبل أي تغيير جوهري في نموذج الخدمة.

٤. اشتراك «برو»

• يُشترى الاشتراك حصراً عبر الشراء داخل التطبيق لدى Apple App Store أو Google Play. لا نبيع اشتراكات بالبطاقة مباشرة ولا خارج المتجرين، ولا نستلم أرقام بطاقات دفع.
• المتجر يعالج عملية الشراء: الأسعار يعرضها المتجر قبل الشراء وقد تختلف باختلاف الدولة والعملة والضرائب وسياسة المتجر.
• التجديد التلقائي: قد يتجدد الاشتراك تلقائياً حتى تلغيه من حساب المتجر. الإلغاء المعتاد يمنع التجديد القادم بينما يستمر وصولك عادة حتى نهاية الفترة المدفوعة. الاسترداد أو الإبطال أو رد المدفوعات أو إجراءات المتجر الاستثنائية قد تُنهي الوصول قبل ذلك.
• الاسترداد تحكمه سياسات المتجر؛ لا يستطيع تأكّد أن يعد باسترداد يسيطر عليه المتجر أو أن ينفذه مباشرة. حقوق المستهلك الإلزامية في بلدك تبقى غير متأثرة.
• الأحقية خادمية: الخادم هو مصدر الحقيقة الوحيد لأحقية «برو»، وأي مؤشر محلي في التطبيق لا يمنح وصولاً. قد يتوقف وصول «برو» عندما ينتهي الاشتراك، أو يُسترد، أو يُبطل، أو يُلغى ويبلغ نهاية فترته، أو يتعذر التحقق منه، أو تبطله Apple أو Google. لا نعد باستمرار الوصول لمجرد أن التطبيق أظهر اشتراكاً فعالاً سابقاً.
• فترة السماح: قد يستمر وصول «برو» مؤقتاً أثناء فترة سماح فوترة تجيزها Apple أو Google عندما يؤكد الخادم بقاء الأحقية؛ الحالة التي يؤكدها المتجر ويتحقق منها الخادم هي الحاكمة، وعند انتهاء فترة السماح المجازة قد يتوقف الوصول وتُحذف بيانات «برو» المخزنة محلياً. لا يمسّ انتهاء الاشتراك ميزة حماية هوية المتصل المجانية.
• استعادة المشتريات تتطلب نجاح التحقق لدى المتجر ولدى خادمنا معاً.
• حذف حساب تأكّد لا يلغي اشتراك المتجر — أدره من حساب Apple أو Google.

٥. المحتوى الذي ترسله

تحتفظ بحقوقك في محتواك، وتمنحنا ترخيصاً محدوداً غير حصري ومؤقتاً لمعالجته فقط من أجل: إجراء الفحص المطلوب، وإرساله لمزوّدي التحليل المبيّنين في سياسة الخصوصية بعد موافقتك الصريحة، واستخراج مؤشرات تهديد (رقم/رابط/نطاق/نمط)، وحماية الخدمة والمستخدمين والتحقيق في إساءة الاستخدام.

تقر بأن لديك الحق أو الإذن اللازم لإرسال المحتوى، وبتقليل البيانات الشخصية والحساسة إلى الضروري. لا ترسل كلمات مرور أو بيانات دفع أو وثائق هوية أو أسراراً غير لازمة للفحص.

٦. الاستخدام المقبول

يُمنع: استخدام التطبيق لصياغة أو تحسين أو اختبار احتيال أو لتجاوز أدوات الكشف · إرسال محتوى غير قانوني أو منتهك للخصوصية أو الملكية أو السرية · انتحال الشخصية أو البلاغات الكاذبة أو التلاعب بقاعدة التهديدات · استخدام نتيجة للتشهير أو المضايقة أو نشر بيانات شخص بلا أساس مشروع · الوصول الآلي المكثف أو تعطيل الخدمة أو تجاوز الحدود والضوابط · استخراج التعليمات الداخلية أو البيانات غير المصرح بها أو إعادة بيع الخدمة دون إذن كتابي.

يجوز لنا تقييد الحساب أو تعليقه بتناسب عند سبب معقول للاعتقاد بمخالفة، مع مراعاة الحقوق التي لا يجوز إسقاطها.

٧. النتائج ليست ضماناً ولا اتهاماً

النتائج تقديرات آلية إرشادية تعتمد على المحتوى والأنماط والمصادر وقت الفحص، وقد تكون ناقصة أو خاطئة أو متأخرة أو غير متاحة.

• «آمن» ليس ضماناً للأمان، و«غير معروف» لا يعني آمناً، و«مشبوه» تحذير لا اتهام رسمي، و«احتيال» تقييم خطر آلي لا حكم قضائي، وغياب البلاغات السابقة لا يثبت المشروعية.
• النتيجة ليست استشارة قانونية أو مالية أو استثمارية أو طبية، ولا تقريراً شرطياً ولا شهادة خبير ولا دليلاً حاسماً، ولا اتهاماً لصاحب رقم أو حساب — فقد يكون منتحلاً أو ضحية.
• تحقق مستقلاً قبل تحويل مال أو مشاركة بيانات أو أي قرار مالي أو قانوني أو وظيفي أو حكومي أو استثماري أو طبي أو متعلق بالهوية، عبر قناة رسمية تختارها بنفسك.
• تأكّد لا يغني عن الشرطة أو البنوك أو الجهات الرقابية أو المحامين أو المستشارين الماليين أو خدمات الطوارئ، ولا تعتمد حصراً على ميزة هوية المتصل. تأكّد لا يعد بحماية كاملة من الاحتيال.

ملاحظات أنواع الفحص:

• الفيديو: الرابط مجاني ويُفحص كرابط. أمّا ملف الفيديو من جهازك فمع «برو»، ويُفحص عبر مشهد واحد ممثِّل يُستخرج محلياً على جهازك ولا يُرفع الملف الكامل؛ وقد لا يلتقط المشهد كل ما في الفيديو، والصوت لا يُفحص، ولا نعد بتحليل كل مشهد أو السياق الكامل.
• تغذيتك الراجعة: خيار «اتضح سليماً» يُسجَّل للمراجعة لكنه لا يغيّر أي حكم تلقائياً أبداً.
• حماية هوية المتصل (مجانية لكل حساب مسجَّل): المطابقة محلية على جهازك وفق القائمة المتزامنة وقت المكالمة؛ الرقم الغائب عن القائمة ليس آمناً بالضرورة؛ الأرقام قابلة للانتحال؛ الميزة رهن بدعم النظام والإعدادات والأذونات والأدوار ونجاح المزامنة وقد لا تتوفر على بعض الأجهزة؛ لا يحظر هذا الإصدار المكالمات تلقائياً، وخيار «حظر» يعرض إرشادات الحظر اليدوي عبر إعدادات النظام؛ وليست الميزة حماية كاملة من المكالمات الاحتيالية. قد تُحذف القائمة المحلية بعد الخروج أو تبديل الحساب أو فشل التخويل.

٨. قاعدة التهديدات والاعتراض والتصحيح

قد نحتفظ بمؤشرات مستخرجة من محتوى صُنّف احتيالياً لحماية المستخدمين؛ وهي إشارات قابلة للمراجعة لا أحكام نهائية. لأي شخص أو شركة أو جهة طلبُ مراجعة أو تصحيح حكمٍ أو إدخال كتالوج أو تصنيف رقم أو نطاق أو متجر أو معلومات غير صحيحة أو متقادمة عبر support@taakad.app. تقديم الاعتراض لا يغيّر النتيجة تلقائياً؛ التصحيح يتبع مراجعة الأدلة وعملية الكتالوج المحكومة. ويحظر استخدام نتائج تأكّد للتشهير أو التحريض أو أي إجراء غير قانوني.

٩. الخصوصية والذكاء الاصطناعي

تُعالَج البيانات وفق سياسة الخصوصية. قبل إرسال محتوى إلى Anthropic أو OpenAI يعرض التطبيق إفصاحاً ويحصل على موافقتك الصريحة. لا توجد حالياً اتفاقية Zero Data Retention نافذة مع المزوّدين؛ وقد يحتفظان بمدخلات ومخرجات API حتى 30 يوماً وفق شروطهما القياسية مع استثناءات قانونية وأمنية.

١٠. المحتوى الترويجي والمدعوم

قد يعرض تأكّد بطاقات ترويجية أو محتوى برعاية تقدمه علامات تجارية مباشرة، مميزاً بوضوح بـ«إعلان» أو «محتوى برعاية». الإعلان ليس توثيقاً أمنياً ولا ضماناً، ولا يؤثر أي معلن أو دفع على الأحكام أو التصنيفات أو الكتالوج، ولا يمكن للرعاية أن تجعل أي جهة «آمنة». وجهات الرعاة الخارجية تحكمها شروطهم وسياساتهم.

١١. الملكية الفكرية

التطبيق والعلامة والتصميم والبرمجيات وكتالوج أنماط الاحتيال والمحتوى الأصلي مملوكة لنا أو لمرخصينا ومحمية قانوناً. لا تمنحك هذه الشروط حق نسخها أو تعديلها أو استخراجها أو إعادة توزيعها خارج الاستخدام الشخصي المعتاد. لا تمنع هذه الشروط الإبلاغ المشروع بحسن نية عن ثغرة أمنية إلى support@taakad.app.

١٢. خدمات الأطراف الثالثة

تعتمد الخدمة على مزوّدين خارجيين منهم Anthropic وOpenAI وSupabase وRender وApple وGoogle، وتخضع خدماتهم لشروطهم، وقد يؤثر توقفهم أو تغييرهم في توفر التطبيق.

١٣. التوفر والتغييرات

قد تتوقف الخدمة مؤقتاً للصيانة أو الأعطال أو لأسباب أمنية أو قانونية. نبذل عناية معقولة لتشغيلها ولا نضمن استمرارها دون انقطاع أو خلوّها من الأخطاء. يجوز تعديل الميزات أو هذه الشروط مع إشعار مناسب قبل التغيير الجوهري حيث يلزم، ولا يُعد مجرد الاستمرار تنازلاً عن حق يتطلب موافقة صريحة.

١٤. الضمانات وحدود المسؤولية

تُقدَّم الخدمة «كما هي» و«حسب التوفر». إلى أقصى حد يسمح به القانون لا نضمن دقة النتائج أو اكتمالها أو ملاءمتها لغرض محدد، ولا نتحمل الخسائر غير المباشرة أو التبعية أو خسارة الفرصة الناتجة عن الاعتماد غير المعقول على نتيجة أو عن توقف الخدمة. لا تستبعد هذه الشروط ولا تحد من مسؤولية لا يجوز استبعادها قانوناً — بمافيها الغش والخطأ الجسيم والإضرار المتعمد — ولا تنتقص من حقوق المستهلك الإلزامية؛ وإذا منحك قانون بلدك حماية أقوى فهي الباقية.

١٥. الإنهاء

يمكنك إنهاء الاستخدام وحذف حسابك في أي وقت — دون اشتراط إلغاء اشتراك المتجر أولاً؛ ويحذف حذفُ الحساب بيانات التطبيق المرتبطة بالحساب (بما فيها سجل فحوصات أجهزته وموافقات التنبيهات ورموز الإشعارات) مع احتفاظ ضيق بما يوجبه منع الاحتيال والقانون كما تفصّله سياسة الخصوصية. تتوفر صفحة حذف خارجية على taakad.app/account-deletion. ويجوز لنا تعليق أو إنهاء الوصول عند مخالفة جوهرية أو خطر أمني أو التزام قانوني. تبقى البنود التي بطبيعتها تستمر بعد الإنهاء سارية (الملكية، حدود المسؤولية، القانون الحاكم).

١٦. القانون الحاكم

تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة بوصف مقدم الخدمة مقيماً فيها، دون المساس بأي حقوق مستهلك أو خصوصية إلزامية غير قابلة للتنازل يمنحها قانون بلد إقامتك. تُحرَّر هذه الوثائق بالعربية والإنجليزية؛ وعند أي تعارض بين النسختين تسود النسخة العربية بالقدر الذي يسمح به القانون الإلزامي المحلي. الاختصاص القضائي لمحاكم دبي، الإمارات العربية المتحدة، وتُرسَل الإخطارات القانونية إلى support@taakad.app. قبل أي دعوى نشجع التواصل عبر support@taakad.app لحل ودي دون مساس بأي مهلة أو حق.

١٧. أحكام المتجرين

هذه الشروط بينك وبين مقدم الخدمة، لا بينك وبين Apple أو Google، وهما لا تشغّلان خدمة تأكّد ولا تتحملان التزامات دعم تتجاوز شروط منصتيهما. الفوترة والإلغاء والاسترداد قد تحكمها جزئياً قواعد المتجر المعني وتُدار من حساب المتجر، وشروط المتجر هي السائدة في المسائل التي يسيطر عليها. لمستخدمي iOS تكون Apple وشركاتها التابعة مستفيداً من الغير من هذه الشروط بالقدر الذي تسمح به قواعد متجرها. حقوقك المحلية الإلزامية تبقى غير متأثرة.

1. Provider and agreement

The TAAKAD application and website ("TAAKAD", "we") are provided by: Shadi Al Hroub — United Arab Emirates. Contact and legal notices: support@taakad.app

By using the app or creating an account you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

2. Capacity

Creating an account and purchasing a subscription require legal capacity to enter this agreement. Anyone lacking it under their local law should use the service through a parent or legal guardian, and parents and guardians may use TAAKAD to protect their families. Do not use the app where your law prohibits it.

3. The service and the two plans

The app lets you submit text, a message, link, phone number, image, or screenshot for checking, returns an indicative result with reasons and verification or reporting suggestions where available, and may provide an account, check history, notifications, export, and account deletion.

TAAKAD offers:

• A Free plan: the core check types, a daily limit on the number of checks, and Caller ID protection for every signed-in account.
• A paid Pro subscription: additional check types, and checking a video FILE from your phone via a scene taken on the device itself, without uploading the file. Checking a video by LINK (YouTube, TikTok, or any URL you paste) is free and goes down the ordinary link path.

Offering a free plan does not commit us to keep it forever or unchanged; we will provide updated disclosures before any material change to the service model.

4. The Pro subscription

• The subscription is purchased exclusively through in-app purchase on the Apple App Store or Google Play. We do not sell subscriptions by direct card payment or outside the two stores, and we never receive payment-card numbers.
• The store processes the purchase: prices are displayed by the applicable store before purchase and may vary by country, currency, taxes, and store policy.
• Auto-renewal: the subscription may renew automatically until you cancel it in your store account. Normal cancellation prevents the next renewal while your access usually continues to the end of the entitled period. Refunds, revocations, chargebacks, or exceptional store actions may end access earlier.
• Refunds are governed by store policies; TAAKAD cannot promise or directly issue a store-controlled refund. Mandatory consumer rights in your country remain unaffected.
• Entitlement is server-side: the server is the sole source of truth for Pro entitlement, and no client-side indicator grants access. Pro access may stop when the subscription expires, is refunded, is revoked, is cancelled and reaches the end of its entitled period, cannot be verified, or is invalidated by Apple or Google. We do not promise continued access merely because the app previously showed an active subscription.
• Grace period: Pro access may temporarily continue during a billing grace period authorized by Apple or Google when the server confirms entitlement; the store-confirmed, server-verified status controls access, and when the authorized grace period ends, Pro access may stop and locally stored Pro-only data may be removed. Subscription expiry does not affect the free Caller ID protection feature.
• Restoring purchases requires successful verification by both the store and our server.
• Deleting a TAAKAD account does not cancel the store subscription — manage it in your Apple or Google account.

5. Content you submit

You retain your rights in your content and grant us a limited, non-exclusive, temporary licence to process it only to: perform the requested check, send it to the analysis providers identified in the Privacy Policy after your explicit permission, extract threat indicators (number/link/domain/pattern), and protect the service and users and investigate abuse.

You represent that you have the right or permission to submit the content and will minimise personal and sensitive data. Do not submit passwords, payment information, identity documents, or secrets unnecessary for the check.

6. Acceptable use

You must not: use the app to draft, improve, or test scams or evade detection · submit unlawful content or content violating privacy, property, or confidentiality · impersonate others, file false reports, or manipulate the threat database · use a result to defame, harass, or unlawfully publish personal data · conduct excessive automated access, disrupt the service, or bypass limits and controls · extract internal instructions or unauthorised data, or resell the service without written permission.

We may proportionately restrict or suspend an account on reasonable belief of a violation, subject to rights that cannot lawfully be excluded.

7. Results are not guarantees or accusations

Results are automated, indicative assessments based on content, patterns, and sources at check time, and may be incomplete, incorrect, delayed, or unavailable.

• "Safe" is not a guarantee of safety; "Unknown" does not mean safe; "Suspicious" is a caution, not a formal accusation; "Scam" is an automated risk assessment, not a judicial judgment; and absence of prior reports does not prove legitimacy.
• A result is not legal, financial, investment, or medical advice, nor a police report, expert certificate, or conclusive evidence, nor an accusation against a number's or account's owner — it may be spoofed or a victim.
• Independently verify before sending money, sharing data, or any sensitive financial, legal, employment, government, investment, medical, or identity matter, using an official channel you select yourself.
• TAAKAD does not replace police, banks, regulators, lawyers, financial advisers, or emergency services; do not rely exclusively on Caller ID. TAAKAD does not promise complete protection from scams.

Check-type notes:

• Video: a link is free and is checked as a link. A video FILE from your phone comes with Pro and is checked via a single representative scene taken locally on your device; the full file is not uploaded, the scene may not capture everything in the video, the sound is not examined, and we do not promise analysis of every scene or full context.
• Your feedback: the "turned out fine" option is recorded for review but never automatically changes any verdict.
• Caller ID protection (free for every signed-in account): matching is local on your device against the list synced at call time; a number absent from the list is not necessarily safe; numbers can be spoofed; the feature depends on OS support, settings, permissions, roles, and successful sync and may be unavailable on some devices; this version does not block calls automatically, and the block option shows instructions for manual blocking through system settings; the feature is not complete protection against fraudulent calls. The local list may be deleted after logout, account switching, or authorization failure.

8. Threat database, challenges, and corrections

We may retain indicators extracted from content classified as fraudulent to protect users; they are reviewable signals, not final determinations. Any person, company, or organization may request review or correction of a verdict, catalog entry, number label, domain classification, store or company information, or outdated data via support@taakad.app. Submitting a challenge does not automatically change a verdict; corrections follow evidence review and the controlled catalog process. Using TAAKAD results to defame, incite, or take unlawful action is prohibited.

9. Privacy and AI

Data is processed under the Privacy Policy. Before content is sent to Anthropic or OpenAI, the app presents a disclosure and obtains your explicit permission. TAAKAD currently has no operative Zero Data Retention agreement with the providers; they may retain API inputs and outputs for up to 30 days under their standard terms, with legal and safety exceptions.

10. Promotional and sponsored content

TAAKAD may display clearly labelled promotional cards or sponsored content provided directly by brands, identified as "Advertisement", "Sponsored", «إعلان», or «محتوى برعاية». An advertisement is not a security endorsement or guarantee; no advertiser or payment influences verdicts, classifications, or the catalog, and sponsorship can never make anything "safe". External sponsor destinations are governed by their own terms and policies.

11. Intellectual property

The app, brand, design, software, scam-pattern catalog, and original content are owned by us or our licensors and legally protected. These Terms grant no right to copy, modify, extract, or redistribute them beyond ordinary personal use. Good-faith security-vulnerability reports to support@taakad.app are not restricted.

12. Third-party services

The service depends on external providers including Anthropic, OpenAI, Supabase, Render, Apple, and Google; their services are subject to their own terms, and their outage or changes may affect availability.

13. Availability and changes

The service may pause for maintenance, faults, or security or legal reasons. We use reasonable care to operate it and do not guarantee uninterrupted or error-free operation. Features or these Terms may change with appropriate notice before material changes where required; mere continued use does not waive a right that legally requires express consent.

14. Warranties and liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, we do not warrant that results are accurate, complete, or fit for a particular purpose, and we are not liable for indirect or consequential losses or lost opportunity arising from unreasonable reliance on a result or from service interruption. These Terms do not exclude or limit liability that cannot lawfully be excluded — including fraud, gross negligence, and intentional harm — and do not diminish mandatory consumer rights; where your country's law grants stronger protection, that protection prevails.

15. Termination

You may stop using the service and delete your account at any time — with no requirement to cancel a store subscription first; account deletion removes account-linked application data (including the devices' check history, alert consents, and push tokens) subject to the narrow lawful retention detailed in the Privacy Policy. An external deletion page is available at taakad.app/account-deletion. We may suspend or terminate access for material breach, security risk, or legal obligation. Clauses that by nature survive termination (property, liability limits, governing law) remain in force.

16. Governing law

These Terms are governed by the laws of the United Arab Emirates, as the provider resides there, without prejudice to any non-waivable consumer or privacy rights granted by the law of your country of residence. These documents are drawn up in Arabic and English; in the event of any conflict between the two versions, the Arabic version prevails to the extent permitted by mandatory local law. Venue and jurisdiction: the courts of Dubai, United Arab Emirates; legal notices are sent to support@taakad.app. Before litigation we encourage contacting support@taakad.app for amicable resolution, without affecting any deadline or right.

17. Store provisions

These Terms are between you and the provider, not between you and Apple or Google; they do not operate the TAAKAD service and owe no support obligations beyond their platform terms. Billing, cancellation, and refunds may be governed partly by the applicable store's rules and are managed in your store account; store terms prevail for store-controlled matters. For iOS users, Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent its store rules allow. Your mandatory local rights remain unaffected.
